Presidential Proclamation Restricts H-1B Visa Holders From Entering the U.S.

Update: The Department of Homeland Security has released additional guidance clarifying that, "The proclamation does not impact the ability of any current visa holder to travel to or from the United States." 

The following message was sent to Harvard H-1B visa holders on September 20:

Dear Harvard H-1B visa holders, 

We write to inform you of the recently issued presidential proclamation ("Restriction on Entry of Certain Nonimmigrant Workers") dated September 19, 2025. This proclamation announces a 12-month suspension of entry into the United States for persons in H-1B status, unless a $100,000 fee is paid to the government. The suspension of entries begins at 12:01 a.m. EDT on Sunday, September 21, 2025.  

While we await further details about implementation, please be aware that by its terms, the proclamation applies to H-1B holders currently outside the U.S. who seek entry after the effective date; those already present in the U.S. appear to be unaffected unless they travel abroad and attempt to return during the proclamation's effective period. The proclamation provides that the government may grant exceptions, but the situation remains fluid as guidance and rulemaking are anticipated in the coming weeks.
